Florida Construction Lien Lawyer

Small mistakes in lien law can cost the entire claim.

Florida construction projects move quickly, and payment disputes arise just as fast. If you are a contractor, subcontractor, supplier, equipment lessor, design professional, or property owner involved in a payment dispute, Florida’s construction lien law often determines whether money can be collected, withheld, secured, or defended.

A construction lien is one of the strongest remedies available on a private construction project because it can attach directly to improved real property. But lien rights are technical. A missed deadline, defective Notice to Owner, improper Claim of Lien, exaggerated lien amount, licensing issue, or failure to timely enforce the lien can change the outcome of the entire dispute. Florida’s construction lien law is governed by Chapter 713, Part I, Florida Statutes.

Montesino Law represents clients in Florida construction lien matters involving Florida Construction Lien Law, Claim of Lien, Construction Lien Defense, Construction Lien Deadlines, Lien Removal, Payment Bond Claims, and related construction payment disputes.

Whether you need to preserve lien rights before a deadline expires, enforce an unpaid construction balance, defend against an improper lien, or evaluate whether a lien is valid, the strategy should begin with the project type, contract structure, licensing status, notice history, payment history, and statutory deadlines.

Private projects typically involve construction liens. Public projects do not. Instead, state projects over $100,000 and local government projects over $200,000 require payment bonds, and claims must be made against those bonds rather than through a lien. These claims arise under the Florida Little Miller Act, FDOT Bond Claims, or, in the case of federal projects, the Federal Miller Act. Related disputes may also involve Change Orders, Breach of Construction Contract, Delay Claims, or construction defects under Chapter 558.
